What are compromise agreements?

Compromise agreements are often given to employees following the termination of employment.  They are used for a variety of circumstances, including circumstances where employees do not wish to return to work after taking maternity/paternity leave, redundancies and general underlying and unresolved grievances.

As part of the agreement, your employee will pay a sum of money and provide other benefits in exchange for your promise not to pursue any claims through an employment tribunal or other means.  These payments are tax free up to £30,000.

Confusingly, compromise agreements may not actually be labelled ‘compromise agreement’.  Where you are ensure of whether you are dealing with a compromise agreement, it is best to be absolutely certain by seeking legal advice.

Seeking advice

For the agreement to be valid, it is absolutely vital that you seek independent legal advice, which can include advice from trade union officials and solicitors.  In-house legal advice will not be considered sufficiently independent for the purposes of a compromise agreement.

Most compromise agreements will include provisions for legal costs, so by going to a solicitor you really have nothing to lose.
